The consultant will join the GCF team as a remote based consultant.

 

Role
Under the guidance of an Associate General Counsel, the Legal Consultant will carry out any legal task required for the support of OGC in a timely manner in close consultation with relevant senior counsels and counsel in OGC.

 

Duties and Responsibilities

 

Purpose

  • Under the guidance of an Associate General Counsel, the Legal Consultant will be responsible for:
  • Assisting in the development of the internal legal framework, amending relevant administrative instructions, policies and procedures, including as part of the transition to a new human resources (HR) framework;
  • Assisting in the development of the internal legal framework governing informal dispute resolution and ethics and conduct issues;
  • Undertakes research into applicable international administrative law case law, in an effort to address administrative and disciplinary cases.
  • Drafting responses to appeals filed in the internal justice system.
  • Providing legal advice on the review, interpretation and application of the regulatory framework of GCF, including the HR framework, administrative instructions, procedures and other administrative issuances;
  • Undertaking other tasks as may be assigned by an Associate General Counsel.

 

Engagement

  • Engaging and coordinating with assigned lawyers and lead Secretariat departments;
  • Advising relevant Secretariat departments on various legal issues arising in the context of the consultant duties;
  • Advising and updating the General Counsel and/or Associate General Counsels on the status and clearance of legal documents, policies and other deliverables to be approved, endorsed and/or signed by the General Counsel and/or
  • Associate General Counsels.

 

Delivery

  • Timely delivery of draft responses to appeals filed in the internal justice system
  • Timely delivery of administrative instructions, policies, procedures and other elements of the regulatory framework
  • Thorough, accurate and timely completion of legal review of relevant documents;
  • Timely confirmation and/or clearance of legal documents; and
  • Sound practical legal advice on institutional legal issues and the regulatory framework of GCF.

 

Required Experience and Qualifications

  • Advanced university degree (Master’s degree or equivalent) in law. A first level university degree in law in combination with the required work experience plus two additional years of qualifying work experience may be accepted in lieu of the advance university degree;
  • Qualification to practice law in at least one jurisdiction;
  • At least 13 years of relevant work experience practicing public international law (particularly international administrative law with a well-recognised law firm, an international financial institution international organization, development institution and/or foreign government) and advising on human resources regulations and rules in an international organization;
  • Experience working and advising on employment relations, dispute resolution, litigation, administrative law, and contract law;
  • Solid legal drafting skills specifically of drafting responses to internal justice system cases, regulations, rules, policies and guidelines within the context of an internal governance framework;
  • Experience liaising with, and advising, senior members of staff; experience advising management is an advantage;
  • Experience in, or working with, developing countries; and
  • Excellent written and oral communication skills in English are essential for this position; knowledge of another UN language is an advantage.

 

Shortlisting the Legal Consultants for a Roster
Upon conclusion of the selection process, GCF will notify all consultants in writing as to whether they have been selected for inclusion in the roster. The Legal Consultants selected for the inclusion in the roster will be expected to enter into an Individual Consultancy contract with GCF, setting out the general terms and conditions that will govern any and all engagements of the consultant by GCF, applicable daily fee and other terms and conditions. Depending on the needs and the nature of the legal matter, candidates on the roster may be contacted to ascertain their availability, following which a simple Purchase Order (PO) will be signed outlining specific list of deliverables, number of days needed and the daily fee as set out in the Individual Consultancy Contract.

 

Additional Considerations

  • Individual Consultancy contracts will be signed for up to 3 (three) years with the possibility of 2 more years of extension.
  • Legal Consultants will be based remotely.
  • Maximum number of working days for a remote consultant is limited to 180 days per year.
  • GCF does not warrant that any quantity of services will be procured during the term of the contract as this will depend on the forthcoming needs and the performance appraisals.
  • The nature of the specific engagements may vary within the overall scope of this Terms of Reference. Specific details may be added as a supplementing ToR for each specific engagement.
